關于加強國有資(zi)金投資(zi)建筑工程項目(mu)監(jian)管(guan)的意見

省(sheng)住房(fang)城鄉(xiang)建(jian)設廳(ting)  省發展改革(ge)委  省審(shen)計廳

為維護公平競爭的建(jian)(jian)筑(zhu)市場環境,從源頭治理國(guo)有(you)資(zi)金(jin)投(tou)資(zi)建(jian)(jian)筑(zhu)工程項目違規操作以(yi)及“低價中(zhong)標、高(gao)價結(jie)算(suan)”等(deng)突(tu)出問題,建(jian)(jian)立健全長(chang)效機制,切實保障國(guo)有(you)資(zi)金(jin)安全,提(ti)高(gao)投(tou)資(zi)效益(yi),結(jie)合(he)我省(sheng)實際(ji),現就(jiu)加強(qiang)國(guo)有(you)資(zi)金(jin)投(tou)資(zi)建(jian)(jian)筑(zhu)工程項目監管提(ti)出以(yi)下意見:

一、完(wan)善招(zhao)標投標制度

(一)規范(fan)項(xiang)(xiang)目(mu)招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)行(xing)(xing)為。國有資(zi)金(jin)投資(zi)建(jian)筑(zhu)工(gong)程項(xiang)(xiang)目(mu)應嚴格按(an)照規定(ding)履行(xing)(xing)審批(pi)(pi)核(he)準程序(xu)。未經審批(pi)(pi)核(he)準的(de)項(xiang)(xiang)目(mu),招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao)監管部門不得(de)(de)為其辦(ban)理招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao)手(shou)續(xu)。依(yi)法必(bi)須(xu)進行(xing)(xing)招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)的(de)項(xiang)(xiang)目(mu),應當(dang)按(an)照審批(pi)(pi)核(he)準的(de)招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)范(fan)圍(wei)、招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)方(fang)式(shi)、招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)組織形式(shi)等開(kai)展招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao)活動(dong)。招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)活動(dong)中(zhong)確需改變招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)事項(xiang)(xiang)的(de),項(xiang)(xiang)目(mu)建(jian)設單(dan)位(wei)應報原審批(pi)(pi)核(he)準部門重新辦(ban)理有關手(shou)續(xu)。任何單(dan)位(wei)和(he)個人(ren)不得(de)(de)將(jiang)依(yi)法必(bi)須(xu)進行(xing)(xing)招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)的(de)項(xiang)(xiang)目(mu)化整(zheng)為零或(huo)(huo)者以(yi)其他任何方(fang)式(shi)規避招(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao),不得(de)(de)將(jiang)應由一個承包(bao)(bao)單(dan)位(wei)承擔(dan)的(de)建(jian)筑(zhu)工(gong)程肢解發包(bao)(bao)給不同的(de)承包(bao)(bao)單(dan)位(wei),不得(de)(de)以(yi)不合理的(de)條件(jian)限制或(huo)(huo)者排斥潛在(zai)投標(biao)(biao)(biao)(biao)(biao)(biao)人(ren),不得(de)(de)對潛在(zai)投標(biao)(biao)(biao)(biao)(biao)(biao)人(ren)實行(xing)(xing)歧視待(dai)遇。

(二)加強招(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao)監(jian)(jian)管(guan)。依法(fa)必須進行招(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)的項目(mu)(mu),應當進入統(tong)一的公(gong)共資(zi)源交(jiao)易平臺進行招(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao)活動,并按照(zhao)項目(mu)(mu)屬地管(guan)理(li)原則,接(jie)受項目(mu)(mu)所在地人民政府指定(ding)的建(jian)(jian)筑(zhu)(zhu)(zhu)工程(cheng)招(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao)監(jian)(jian)管(guan)部門監(jian)(jian)管(guan)。未按規定(ding)進入統(tong)一的公(gong)共資(zi)源交(jiao)易平臺進行施工招(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao)的,視為未依法(fa)確定(ding)建(jian)(jian)筑(zhu)(zhu)(zhu)施工企業(ye)。未依法(fa)確定(ding)建(jian)(jian)筑(zhu)(zhu)(zhu)施工企業(ye)的,建(jian)(jian)設行政主管(guan)部門不(bu)得辦理(li)施工許可。推進建(jian)(jian)筑(zhu)(zhu)(zhu)工程(cheng)項目(mu)(mu)電子招(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao),提(ti)高(gao)招(zhao)(zhao)(zhao)標(biao)(biao)(biao)(biao)(biao)(biao)投標(biao)(biao)(biao)(biao)(biao)(biao)效率。提(ti)倡優質(zhi)優價、優質(zhi)優先,堅(jian)決遏制和打(da)擊圍(wei)標(biao)(biao)(biao)(biao)(biao)(biao)串標(biao)(biao)(biao)(biao)(biao)(biao)、轉(zhuan)包(bao)、掛靠(kao)和低(di)于成(cheng)本價報(bao)價等違法(fa)違規行為。

(三)推進建(jian)(jian)筑(zhu)(zhu)市(shi)場信(xin)用(yong)信(xin)息(xi)應用(yong)。進一步(bu)強化省公(gong)共(gong)資(zi)(zi)源(yuan)交易監(jian)(jian)管(guan)平臺、工(gong)程建(jian)(jian)設監(jian)(jian)管(guan)和信(xin)用(yong)管(guan)理平臺建(jian)(jian)設,實現與省公(gong)共(gong)信(xin)用(yong)信(xin)息(xi)共(gong)享服(fu)務平臺互聯互通(tong),及時掌握(wo)國(guo)有(you)(you)資(zi)(zi)金投(tou)(tou)資(zi)(zi)建(jian)(jian)筑(zhu)(zhu)工(gong)程項(xiang)目投(tou)(tou)標人的信(xin)用(yong)信(xin)息(xi),并將信(xin)用(yong)評定結(jie)果(guo)應用(yong)于招標投(tou)(tou)標活動中(zhong),擇優確定投(tou)(tou)標人、中(zhong)標人。國(guo)有(you)(you)資(zi)(zi)金投(tou)(tou)資(zi)(zi)建(jian)(jian)筑(zhu)(zhu)工(gong)程項(xiang)目招標投(tou)(tou)標活動中(zhong)應當開(kai)展行賄犯罪檔案查詢,對(dui)有(you)(you)行賄犯罪記錄(lu)的單位和個人按規(gui)定作(zuo)出一定時期內限制進入市(shi)場、取消(xiao)投(tou)(tou)標資(zi)(zi)格等處置。

二、加(jia)強工(gong)程造價管理

(四(si))嚴(yan)格控(kong)制(zhi)(zhi)項目總投(tou)資(zi)。經批復核定的(de)(de)初步設計(ji)(ji)及(ji)概(gai)算(suan)是項目建設和控(kong)制(zhi)(zhi)投(tou)資(zi)的(de)(de)基(ji)本(ben)依據,任何單位和個(ge)人不得(de)擅自增加(jia)建設內容、擴大建設規模、提高建設標準或(huo)改變設計(ji)(ji)方案。建設單位應當(dang)實行全過程造(zao)價控(kong)制(zhi)(zhi),以投(tou)資(zi)估算(suan)控(kong)制(zhi)(zhi)設計(ji)(ji)概(gai)算(suan),以設計(ji)(ji)概(gai)算(suan)控(kong)制(zhi)(zhi)施(shi)工(gong)圖預(yu)算(suan),以施(shi)工(gong)圖預(yu)算(suan)控(kong)制(zhi)(zhi)工(gong)程結算(suan),確保項目總投(tou)資(zi)控(kong)制(zhi)(zhi)在(zai)設計(ji)(ji)概(gai)算(suan)以內。

(五)科學編制工(gong)程(cheng)(cheng)造價(jia)。國有資金投(tou)資建筑(zhu)工(gong)程(cheng)(cheng)項目(mu)(mu)應當(dang)采用工(gong)程(cheng)(cheng)量清單計價(jia)方式編制工(gong)程(cheng)(cheng)造價(jia),合(he)理設(she)(she)置(zhi)并公布最(zui)高(gao)(gao)投(tou)標(biao)限價(jia)。嚴格(ge)控制招(zhao)標(biao)暫估(gu)價(jia)設(she)(she)置(zhi),暫估(gu)價(jia)累計金額不得(de)超過(guo)(guo)最(zui)高(gao)(gao)投(tou)標(biao)限價(jia)的(de)(de)10%,超過(guo)(guo)10%的(de)(de)不予備案(an)。以(yi)暫估(gu)價(jia)形式包(bao)(bao)括在總承包(bao)(bao)范(fan)圍內的(de)(de)工(gong)程(cheng)(cheng)、貨物、服務,屬于依法必須進行招(zhao)標(biao)的(de)(de)項目(mu)(mu)范(fan)圍,且達到國家規定規模(mo)標(biao)準的(de)(de),應當(dang)依法公開招(zhao)標(biao)。招(zhao)標(biao)項目(mu)(mu)的(de)(de)合(he)同條款中應當(dang)約定負責實施暫估(gu)價(jia)項目(mu)(mu)招(zhao)標(biao)的(de)(de)主體以(yi)及相應的(de)(de)招(zhao)標(biao)程(cheng)(cheng)序。

(六)加強合(he)(he)(he)同(tong)(tong)(tong)價(jia)格(ge)管(guan)理。招(zhao)標(biao)(biao)人(ren)和中標(biao)(biao)人(ren)應當(dang)按(an)照(zhao)法律(lv)法規規定簽訂書面合(he)(he)(he)同(tong)(tong)(tong),合(he)(he)(he)同(tong)(tong)(tong)的(de)標(biao)(biao)的(de)、價(jia)款(kuan)、質量、履行(xing)期限等主要條款(kuan)應當(dang)與招(zhao)標(biao)(biao)文件(jian)和中標(biao)(biao)人(ren)的(de)投標(biao)(biao)文件(jian)的(de)內容相一致。招(zhao)標(biao)(biao)人(ren)和中標(biao)(biao)人(ren)不得再另(ling)行(xing)訂立(li)背離合(he)(he)(he)同(tong)(tong)(tong)實質性內容的(de)其他協議(yi)。當(dang)事人(ren)就同(tong)(tong)(tong)一工程(cheng)另(ling)行(xing)訂立(li)的(de)建(jian)設工程(cheng)施工合(he)(he)(he)同(tong)(tong)(tong)與經過備(bei)案(an)的(de)中標(biao)(biao)合(he)(he)(he)同(tong)(tong)(tong)實質性內容不一致的(de),以備(bei)案(an)的(de)中標(biao)(biao)合(he)(he)(he)同(tong)(tong)(tong)作為結算(suan)工程(cheng)價(jia)款(kuan)的(de)根據。

(七)嚴(yan)(yan)格(ge)控制(zhi)(zhi)工(gong)程(cheng)(cheng)變(bian)(bian)(bian)更(geng)(geng)。各(ge)地應(ying)結合(he)實際,進(jin)一步建(jian)立(li)健全(quan)工(gong)程(cheng)(cheng)變(bian)(bian)(bian)更(geng)(geng)管理制(zhi)(zhi)度,明(ming)確(que)工(gong)程(cheng)(cheng)變(bian)(bian)(bian)更(geng)(geng)的條件、方式和造價確(que)定(ding),除涉及工(gong)程(cheng)(cheng)結構(gou)安全(quan)等必須變(bian)(bian)(bian)更(geng)(geng)外,對(dui)其他變(bian)(bian)(bian)更(geng)(geng)應(ying)從(cong)嚴(yan)(yan)控制(zhi)(zhi)。嚴(yan)(yan)格(ge)工(gong)程(cheng)(cheng)變(bian)(bian)(bian)更(geng)(geng)分級審(shen)(shen)(shen)核程(cheng)(cheng)序(xu),對(dui)重大(da)設計變(bian)(bian)(bian)更(geng)(geng),必須報原(yuan)審(shen)(shen)(shen)批(pi)部門審(shen)(shen)(shen)批(pi),且在施工(gong)現場公示(shi)審(shen)(shen)(shen)批(pi)后(hou)的變(bian)(bian)(bian)更(geng)(geng)內容。明(ming)確(que)工(gong)程(cheng)(cheng)變(bian)(bian)(bian)更(geng)(geng)申報、審(shen)(shen)(shen)核、批(pi)準各(ge)環節責(ze)任,落(luo)實“誰(shui)簽(qian)字、誰(shui)負責(ze)”的工(gong)程(cheng)(cheng)變(bian)(bian)(bian)更(geng)(geng)責(ze)任追究制(zhi)(zhi)度。

(八)強化結(jie)算(suan)(suan)管理。工(gong)程(cheng)發包、承(cheng)包單位應(ying)按(an)合同約定(ding)和規定(ding)程(cheng)序辦(ban)理過程(cheng)結(jie)算(suan)(suan)。工(gong)程(cheng)竣(jun)工(gong)驗收(shou)后,承(cheng)包單位應(ying)及(ji)時編(bian)制(zhi)(zhi)竣(jun)工(gong)結(jie)算(suan)(suan),建(jian)設單位應(ying)按(an)規定(ding)審核竣(jun)工(gong)結(jie)算(suan)(suan),并將竣(jun)工(gong)結(jie)算(suan)(suan)文(wen)件作為工(gong)程(cheng)竣(jun)工(gong)驗收(shou)備案的必備文(wen)件。嚴格執行最高投標限(xian)價、合同價、竣(jun)工(gong)結(jie)算(suan)(suan)價“三備案”制(zhi)(zhi)度。

三、強(qiang)化責任落實

(九)加(jia)強(qiang)組織領導(dao)。完(wan)善地(di)方(fang)政(zheng)府(fu)統(tong)一領導(dao),住(zhu)房城(cheng)鄉(xiang)建設、發(fa)(fa)展改(gai)革(ge)、審(shen)計(ji)、招標(biao)投(tou)標(biao)等監(jian)(jian)督(du)管(guan)(guan)理部門(men)(men)各司其職(zhi)、協同配合的監(jian)(jian)管(guan)(guan)長效(xiao)機制(zhi)。監(jian)(jian)督(du)管(guan)(guan)理部門(men)(men)應當(dang)依據職(zhi)責權限,加(jia)強(qiang)對國有(you)資金投(tou)資建筑工程(cheng)項目的審(shen)批核準(zhun)、行(xing)政(zheng)許可(ke)和(he)備(bei)案管(guan)(guan)理,規(gui)(gui)(gui)范(fan)招標(biao)投(tou)標(biao)、工程(cheng)變更等活動(dong),及時(shi)發(fa)(fa)現和(he)查處違法(fa)違規(gui)(gui)(gui)行(xing)為。實行(xing)項目審(shen)計(ji)全覆蓋(gai),建立多部門(men)(men)信息共享、審(shen)計(ji)移送處理的合作機制(zhi)。因(yin)監(jian)(jian)督(du)管(guan)(guan)理部門(men)(men)未履行(xing)職(zhi)責或違反相(xiang)(xiang)關規(gui)(gui)(gui)定增加(jia)建設內容、擴(kuo)大建設規(gui)(gui)(gui)模、提(ti)高建設標(biao)準(zhun)、改(gai)變設計(ji)方(fang)案導(dao)致工程(cheng)造(zao)價超概(gai)算的,應當(dang)依法(fa)依規(gui)(gui)(gui)對直接負責的主管(guan)(guan)人員和(he)其他(ta)責任(ren)人員進(jin)行(xing)誡勉(mian)談話、通報批評或者給予相(xiang)(xiang)應處分。省住(zhu)房城(cheng)鄉(xiang)建設廳會同省發(fa)(fa)展改(gai)革(ge)委、省審(shen)計(ji)廳等適時(shi)開展督(du)查。

(十)加(jia)大查(cha)處(chu)力度。嚴(yan)格落實(shi)建(jian)(jian)(jian)(jian)設(she)(she)、勘察(cha)(cha)(cha)、設(she)(she)計、施(shi)工(gong)、監理等(deng)各方(fang)主體責任(ren)(ren),加(jia)強對施(shi)工(gong)圖設(she)(she)計文件(jian)審查(cha)、工(gong)程(cheng)造(zao)(zao)(zao)價(jia)(jia)咨詢、招(zhao)標(biao)代(dai)理等(deng)中(zhong)介機(ji)構(gou)的(de)管理。因項目(mu)建(jian)(jian)(jian)(jian)設(she)(she)單(dan)位(wei)(wei)擅自增(zeng)加(jia)建(jian)(jian)(jian)(jian)設(she)(she)內容(rong)、擴大建(jian)(jian)(jian)(jian)設(she)(she)規模、提高建(jian)(jian)(jian)(jian)設(she)(she)標(biao)準、改(gai)變設(she)(she)計方(fang)案,或(huo)(huo)者由于管理不(bu)善(shan)、故意漏項、報(bao)小建(jian)(jian)(jian)(jian)大等(deng)導致工(gong)程(cheng)造(zao)(zao)(zao)價(jia)(jia)超概算(suan)的(de),當地政(zheng)府應當依(yi)法(fa)(fa)(fa)依(yi)規對項目(mu)建(jian)(jian)(jian)(jian)設(she)(she)單(dan)位(wei)(wei)主要負(fu)責人和直接負(fu)責的(de)主管人員(yuan)以及其他責任(ren)(ren)人員(yuan)進行(xing)誡(jie)勉談話(hua)、通(tong)報(bao)批評或(huo)(huo)者給予(yu)相應處(chu)分。因勘察(cha)(cha)(cha)、設(she)(she)計單(dan)位(wei)(wei)未(wei)按照項目(mu)審批核準文件(jian)、工(gong)程(cheng)建(jian)(jian)(jian)(jian)設(she)(she)強制性標(biao)準和國家規定的(de)工(gong)程(cheng)勘察(cha)(cha)(cha)、設(she)(she)計深(shen)度要求等(deng)編(bian)制勘察(cha)(cha)(cha)、設(she)(she)計文件(jian)造(zao)(zao)(zao)成工(gong)程(cheng)造(zao)(zao)(zao)價(jia)(jia)超概算(suan)的(de),因施(shi)工(gong)、監理單(dan)位(wei)(wei)或(huo)(huo)者施(shi)工(gong)圖設(she)(she)計文件(jian)審查(cha)、工(gong)程(cheng)造(zao)(zao)(zao)價(jia)(jia)咨詢、招(zhao)標(biao)代(dai)理等(deng)中(zhong)介機(ji)構(gou)違法(fa)(fa)(fa)違規行(xing)為造(zao)(zao)(zao)成工(gong)程(cheng)造(zao)(zao)(zao)價(jia)(jia)超概算(suan)的(de),項目(mu)建(jian)(jian)(jian)(jian)設(she)(she)單(dan)位(wei)(wei)可(ke)以根據(ju)法(fa)(fa)(fa)律法(fa)(fa)(fa)規和合(he)同約定向有關單(dan)位(wei)(wei)追償。建(jian)(jian)(jian)(jian)設(she)(she)行(xing)政(zheng)主管部門視(shi)情(qing)節輕(qing)重,依(yi)法(fa)(fa)(fa)給予(yu)相應行(xing)政(zheng)處(chu)罰(fa)并記(ji)入(ru)不(bu)良(liang)信用記(ji)錄,情(qing)節嚴(yan)重的(de)列入(ru)黑名單(dan)。

(十一)加強信息公(gong)開(kai)。凡不涉及(ji)國(guo)(guo)家(jia)安全和國(guo)(guo)家(jia)秘(mi)密、法律(lv)法規(gui)未禁止公(gong)開(kai)的(de)國(guo)(guo)有(you)資(zi)金(jin)投資(zi)建筑(zhu)工(gong)(gong)程(cheng)項目,應當依(yi)托(tuo)省(sheng)公(gong)共資(zi)源交易監(jian)(jian)管(guan)平(ping)臺、省(sheng)工(gong)(gong)程(cheng)建設監(jian)(jian)管(guan)和信用管(guan)理平(ping)臺、省(sheng)建設工(gong)(gong)程(cheng)造價(jia)(jia)全過程(cheng)監(jian)(jian)管(guan)平(ping)臺和當地主要(yao)媒體(ti),按照有(you)關(guan)(guan)規(gui)定向社(she)會(hui)公(gong)開(kai)項目信息,包(bao)括(kuo)項目名(ming)稱、規(gui)模、投資(zi)估算、設計(ji)概算、開(kai)竣(jun)工(gong)(gong)時間、交易信息、中標價(jia)(jia)、合同價(jia)(jia)、履約信息、結算價(jia)(jia)、決算價(jia)(jia)、有(you)關(guan)(guan)變更信息、增加造價(jia)(jia)的(de)原因,以(yi)及(ji)相關(guan)(guan)責(ze)任主體(ti)、監(jian)(jian)管(guan)處(chu)罰情(qing)況等,并(bing)公(gong)布(bu)舉報投訴電話,接受社(she)會(hui)和群眾監(jian)(jian)督(du)。
