關于健全支持中小企業發展制度的若干意見

各省、自治區、直轄市及計劃單列市人民政府,新(xin)疆生產建設兵團:




中(zhong)(zhong)小企(qi)業是(shi)國(guo)民經(jing)濟和(he)社會(hui)發(fa)(fa)(fa)展(zhan)(zhan)(zhan)的(de)主力軍,是(shi)建設現代化經(jing)濟體系(xi)、推動經(jing)濟高質(zhi)量發(fa)(fa)(fa)展(zhan)(zhan)(zhan)的(de)重要基(ji)礎(chu),是(shi)擴大就(jiu)(jiu)業、改(gai)善(shan)民生的(de)重要支(zhi)撐,是(shi)企(qi)業家精(jing)(jing)神的(de)重要發(fa)(fa)(fa)源地。黨中(zhong)(zhong)央(yang)、國(guo)務院高度重視中(zhong)(zhong)小企(qi)業發(fa)(fa)(fa)展(zhan)(zhan)(zhan),近年來(lai)出(chu)(chu)臺了一(yi)系(xi)列政策(ce)措施,有關工作取得積極成(cheng)效(xiao),但仍(reng)存在一(yi)些(xie)突出(chu)(chu)問題,特別是(shi)一(yi)些(xie)基(ji)礎(chu)性(xing)制度性(xing)問題亟待解(jie)決。為深入貫徹黨的(de)十九屆四中(zhong)(zhong)全會(hui)精(jing)(jing)神,堅持(chi)(chi)和(he)完(wan)善(shan)社會(hui)主義基(ji)本經(jing)濟制度,堅持(chi)(chi)“兩個毫不動搖(yao)”,形成(cheng)支(zhi)持(chi)(chi)中(zhong)(zhong)小企(qi)業發(fa)(fa)(fa)展(zhan)(zhan)(zhan)的(de)常態(tai)化、長(chang)效(xiao)化機制,促進中(zhong)(zhong)小企(qi)業高質(zhi)量發(fa)(fa)(fa)展(zhan)(zhan)(zhan),經(jing)國(guo)務院同意,現就(jiu)(jiu)健(jian)全支(zhi)持(chi)(chi)中(zhong)(zhong)小企(qi)業發(fa)(fa)(fa)展(zhan)(zhan)(zhan)制度,提出(chu)(chu)如下意見(jian)。




一、完善支持中小企業(ye)發展的基礎性(xing)制度




(一)健全中(zhong)(zhong)(zhong)小企(qi)業(ye)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)體系(xi)。以《中(zhong)(zhong)(zhong)小企(qi)業(ye)促進(jin)法(fa)(fa)(fa)(fa)》為基礎,加快構(gou)建具有中(zhong)(zhong)(zhong)國特色、支持中(zhong)(zhong)(zhong)小企(qi)業(ye)發展、保護(hu)中(zhong)(zhong)(zhong)小企(qi)業(ye)合法(fa)(fa)(fa)(fa)權(quan)益的法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)體系(xi)。鼓勵地(di)方(fang)(fang)依法(fa)(fa)(fa)(fa)制定本地(di)促進(jin)中(zhong)(zhong)(zhong)小企(qi)業(ye)發展的地(di)方(fang)(fang)法(fa)(fa)(fa)(fa)規(gui)。探(tan)索建立中(zhong)(zhong)(zhong)小企(qi)業(ye)法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)評估制度和執行情(qing)況檢查制度,督促法(fa)(fa)(fa)(fa)律法(fa)(fa)(fa)(fa)規(gui)落實到位。




(二)堅持公(gong)平(ping)(ping)競(jing)爭(zheng)(zheng)制(zhi)(zhi)度(du)。全(quan)(quan)面實施市場準(zhun)入(ru)負(fu)面清單制(zhi)(zhi)度(du),公(gong)正(zheng)公(gong)平(ping)(ping)對待中小企(qi)業(ye),破除(chu)不合理門檻(jian)和限制(zhi)(zhi),實現大中小企(qi)業(ye)和各種所有(you)制(zhi)(zhi)經濟權利(li)平(ping)(ping)等、機會平(ping)(ping)等、規則平(ping)(ping)等。全(quan)(quan)面落實公(gong)平(ping)(ping)競(jing)爭(zheng)(zheng)審查(cha)(cha)制(zhi)(zhi)度(du),完善審查(cha)(cha)流程(cheng)和標(biao)準(zhun),建立(li)健(jian)全(quan)(quan)公(gong)平(ping)(ping)競(jing)爭(zheng)(zheng)審查(cha)(cha)投訴、公(gong)示、抽查(cha)(cha)制(zhi)(zhi)度(du)。加(jia)強和改進反壟斷(duan)和反不正(zheng)當(dang)競(jing)爭(zheng)(zheng)執法,維護市場競(jing)爭(zheng)(zheng)秩(zhi)序。




(三)完善(shan)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)統(tong)計(ji)監測(ce)(ce)和發布(bu)制度。健(jian)全中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)統(tong)計(ji)監測(ce)(ce)制度,定期發布(bu)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)統(tong)計(ji)數(shu)據(ju)。建立中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)融(rong)資狀況(kuang)調查統(tong)計(ji)制度,編制中(zhong)(zhong)小(xiao)(xiao)微(wei)企(qi)(qi)業(ye)(ye)金融(rong)條件(jian)指數(shu)。加強中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)結構化分析(xi),提高(gao)統(tong)計(ji)監測(ce)(ce)分析(xi)水平。探索利用大數(shu)據(ju)等手段開展中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)運行監測(ce)(ce)分析(xi)。完善(shan)《中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)主要統(tong)計(ji)數(shu)據(ju)》手冊,研究編制中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)發展指數(shu)。適時修訂(ding)中(zhong)(zhong)小(xiao)(xiao)企(qi)(qi)業(ye)(ye)劃型標準。




(四)健全中(zhong)小(xiao)企業(ye)信(xin)用(yong)(yong)制(zhi)度。堅持“政府+市(shi)場(chang)”的(de)模(mo)式,建立(li)(li)健全中(zhong)小(xiao)企業(ye)信(xin)用(yong)(yong)信(xin)息歸(gui)集、共享(xiang)、查詢(xun)機制(zhi),依托全國信(xin)用(yong)(yong)信(xin)息共享(xiang)平臺,及時整合共享(xiang)各類涉(she)企公共服(fu)務數(shu)據(ju)。建立(li)(li)健全中(zhong)小(xiao)企業(ye)信(xin)用(yong)(yong)評價體系(xi),完善金融信(xin)用(yong)(yong)信(xin)息基(ji)礎(chu)數(shu)據(ju)庫,創新(xin)小(xiao)微(wei)企業(ye)征信(xin)產品,高效對接金融服(fu)務。研究出臺有(you)關法(fa)律法(fa)規,規范中(zhong)小(xiao)企業(ye)信(xin)用(yong)(yong)信(xin)息采集、公示查詢(xun)和信(xin)用(yong)(yong)監(jian)管等。發揮(hui)國家(jia)企業(ye)信(xin)用(yong)(yong)信(xin)息公示系(xi)統的(de)基(ji)礎(chu)作用(yong)(yong),將(jiang)涉(she)企信(xin)息記于企業(ye)名(ming)下并依法(fa)公示。




(五)完善(shan)公(gong)正監(jian)(jian)(jian)管(guan)制(zhi)度。減少監(jian)(jian)(jian)管(guan)事(shi)項,簡(jian)化辦(ban)事(shi)流程,推(tui)廣全(quan)程網(wang)上(shang)辦(ban)、引導幫辦(ban),全(quan)面推(tui)行信(xin)用(yong)監(jian)(jian)(jian)管(guan)和“互(hu)聯網(wang)+監(jian)(jian)(jian)管(guan)”改(gai)革(ge)。推(tui)進分(fen)級(ji)分(fen)類、跨部門聯合監(jian)(jian)(jian)管(guan),加強和規范事(shi)中事(shi)后監(jian)(jian)(jian)管(guan),落實和完善(shan)包容審慎(shen)監(jian)(jian)(jian)管(guan),避免對中小企業采取簡(jian)單(dan)粗暴處理措施,對“一刀切”行為嚴肅查處。






二、堅持和完善中小企業財稅支持制度




(六)健全(quan)精準有(you)(you)效的(de)(de)財(cai)政(zheng)(zheng)支(zhi)持制度。中(zhong)(zhong)央財(cai)政(zheng)(zheng)設(she)立(li)(li)中(zhong)(zhong)小(xiao)企(qi)(qi)業(ye)科目,縣級以(yi)上財(cai)政(zheng)(zheng)根據實(shi)際情況安排中(zhong)(zhong)小(xiao)企(qi)(qi)業(ye)發展專項(xiang)(xiang)資(zi)金(jin)(jin)。建(jian)立(li)(li)國家中(zhong)(zhong)小(xiao)企(qi)(qi)業(ye)發展基金(jin)(jin)公司制母基金(jin)(jin),健全(quan)基金(jin)(jin)管理制度,完善基金(jin)(jin)市(shi)場化運作機制,引導有(you)(you)條件的(de)(de)地方政(zheng)(zheng)府設(she)立(li)(li)中(zhong)(zhong)小(xiao)企(qi)(qi)業(ye)發展基金(jin)(jin)。完善專項(xiang)(xiang)資(zi)金(jin)(jin)管理辦法,加強資(zi)金(jin)(jin)績效評價。




(七)建(jian)立(li)減(jian)(jian)輕小(xiao)(xiao)微企業(ye)(ye)(ye)稅(shui)費(fei)(fei)負(fu)擔長效機(ji)制。實行(xing)(xing)(xing)有利(li)于(yu)小(xiao)(xiao)微企業(ye)(ye)(ye)發展的(de)稅(shui)收(shou)(shou)(shou)政策(ce),依法對符合條(tiao)件的(de)小(xiao)(xiao)微企業(ye)(ye)(ye)按照規定實行(xing)(xing)(xing)緩征(zheng)、減(jian)(jian)征(zheng)、免征(zheng)企業(ye)(ye)(ye)所得(de)稅(shui)、增值(zhi)稅(shui)等措(cuo)施,簡化稅(shui)收(shou)(shou)(shou)征(zheng)管程序;對小(xiao)(xiao)微企業(ye)(ye)(ye)行(xing)(xing)(xing)政事業(ye)(ye)(ye)性(xing)收(shou)(shou)(shou)費(fei)(fei)實行(xing)(xing)(xing)減(jian)(jian)免等優惠政策(ce),減(jian)(jian)輕小(xiao)(xiao)微企業(ye)(ye)(ye)稅(shui)費(fei)(fei)負(fu)擔。落實好涉企收(shou)(shou)(shou)費(fei)(fei)目錄清單(dan)制度,加(jia)強(qiang)涉企收(shou)(shou)(shou)費(fei)(fei)監督檢(jian)查,清理規范涉企收(shou)(shou)(shou)費(fei)(fei)。




(八)強化政府采(cai)(cai)購(gou)(gou)支持中(zhong)小(xiao)企業(ye)政策機制。修訂(ding)《政府采(cai)(cai)購(gou)(gou)促進中(zhong)小(xiao)企業(ye)發展暫行辦(ban)法(fa)》,完善預留(liu)采(cai)(cai)購(gou)(gou)份額、價(jia)格評審優惠(hui)等(deng)措施,提高中(zhong)小(xiao)企業(ye)在政府采(cai)(cai)購(gou)(gou)中(zhong)的(de)(de)份額。向(xiang)中(zhong)小(xiao)企業(ye)預留(liu)采(cai)(cai)購(gou)(gou)份額應占本部(bu)門年度(du)政府采(cai)(cai)購(gou)(gou)項目預算總額的(de)(de)30%以上;其中(zhong),預留(liu)給小(xiao)微企業(ye)的(de)(de)比例不低于(yu)60%。




三、堅持(chi)和完善中(zhong)小企業融資促(cu)進制度




(九)優化貨(huo)幣信貸(dai)傳導機(ji)制(zhi)。綜合運用支小(xiao)再貸(dai)款(kuan)、再貼(tie)現(xian)、差別存款(kuan)準備金率(lv)(lv)等貨(huo)幣政策工(gong)具,引(yin)導商業銀行增加小(xiao)微企(qi)業信貸(dai)投(tou)放。進一步疏通利(li)率(lv)(lv)傳導渠道,確(que)保貸(dai)款(kuan)市場(chang)報價利(li)率(lv)(lv)(LPR)有效傳導至貸(dai)款(kuan)利(li)率(lv)(lv)。建立(li)差異化小(xiao)微企(qi)業利(li)率(lv)(lv)定價機(ji)制(zhi),促進信貸(dai)利(li)率(lv)(lv)和費用公(gong)開透明,保持(chi)小(xiao)微企(qi)業貸(dai)款(kuan)利(li)率(lv)(lv)定價合理(li)水(shui)平。




(十)健全多層次小(xiao)(xiao)(xiao)微企(qi)業金(jin)(jin)融(rong)服(fu)務(wu)(wu)體系(xi)。推進(jin)普(pu)惠金(jin)(jin)融(rong)體系(xi)建設,深化大中(zhong)型銀行普(pu)惠金(jin)(jin)融(rong)事業部改革,推動(dong)(dong)中(zhong)小(xiao)(xiao)(xiao)銀行、非(fei)(fei)存款(kuan)類(lei)金(jin)(jin)融(rong)機構(gou)和互聯網金(jin)(jin)融(rong)有序健康發展(zhan)。鼓勵(li)金(jin)(jin)融(rong)機構(gou)創新產(chan)品和服(fu)務(wu)(wu),發展(zhan)便(bian)利續貸(dai)業務(wu)(wu)和信用貸(dai)款(kuan),增(zeng)加小(xiao)(xiao)(xiao)微企(qi)業首貸(dai)、中(zhong)長期貸(dai)款(kuan)、知識產(chan)權(quan)質(zhi)押(ya)貸(dai)款(kuan)等,開展(zhan)供應鏈金(jin)(jin)融(rong)、應收(shou)賬(zhang)款(kuan)融(rong)資,加強銀稅互動(dong)(dong)。推動(dong)(dong)金(jin)(jin)融(rong)科技(ji)賦(fu)能金(jin)(jin)融(rong)機構(gou)服(fu)務(wu)(wu)中(zhong)小(xiao)(xiao)(xiao)企(qi)業。研究出(chu)臺《非(fei)(fei)存款(kuan)類(lei)放貸(dai)組織條例》。加快推進(jin)小(xiao)(xiao)(xiao)額金(jin)(jin)融(rong)糾紛快速解決等機制(zhi)建設。完善規范銀行業涉企(qi)服(fu)務(wu)(wu)收(shou)費(fei)監管法規制(zhi)度,降低小(xiao)(xiao)(xiao)微企(qi)業綜合性融(rong)資成本(ben)。




(十一)強化(hua)小(xiao)(xiao)微(wei)企(qi)業(ye)(ye)(ye)(ye)金(jin)融(rong)(rong)(rong)差異化(hua)監(jian)(jian)(jian)管(guan)激勵機(ji)制。健全商(shang)業(ye)(ye)(ye)(ye)銀(yin)行小(xiao)(xiao)微(wei)企(qi)業(ye)(ye)(ye)(ye)金(jin)融(rong)(rong)(rong)服務監(jian)(jian)(jian)管(guan)長(chang)效(xiao)機(ji)制,出臺《商(shang)業(ye)(ye)(ye)(ye)銀(yin)行小(xiao)(xiao)微(wei)企(qi)業(ye)(ye)(ye)(ye)金(jin)融(rong)(rong)(rong)服務監(jian)(jian)(jian)管(guan)評價辦(ban)法》。修(xiu)訂《金(jin)融(rong)(rong)(rong)企(qi)業(ye)(ye)(ye)(ye)績(ji)效(xiao)評價辦(ban)法》。將商(shang)業(ye)(ye)(ye)(ye)銀(yin)行小(xiao)(xiao)微(wei)企(qi)業(ye)(ye)(ye)(ye)服務情況與資(zi)本補充、金(jin)融(rong)(rong)(rong)債發行、宏(hong)觀審慎評估(MPA)考(kao)核、金(jin)融(rong)(rong)(rong)機(ji)構總部相關負(fu)責人考(kao)核及提(ti)任掛鉤。引導銀(yin)行業(ye)(ye)(ye)(ye)金(jin)融(rong)(rong)(rong)機(ji)構探索建立授信(xin)盡職(zhi)免(mian)責負(fu)面清單(dan)制度。督促商(shang)業(ye)(ye)(ye)(ye)銀(yin)行優化(hua)內(nei)部信(xin)貸(dai)資(zi)源配置(zhi)和考(kao)核激勵機(ji)制,單(dan)列小(xiao)(xiao)微(wei)企(qi)業(ye)(ye)(ye)(ye)信(xin)貸(dai)計劃,改(gai)進貸(dai)款服務方式。




(十二)完(wan)善(shan)中小(xiao)企業(ye)(ye)(ye)直接融(rong)資(zi)(zi)支持制(zhi)(zhi)(zhi)度。大(da)力培育創業(ye)(ye)(ye)投(tou)(tou)(tou)(tou)資(zi)(zi)市(shi)場(chang),完(wan)善(shan)創業(ye)(ye)(ye)投(tou)(tou)(tou)(tou)資(zi)(zi)激(ji)勵和退出機制(zhi)(zhi)(zhi),引(yin)導天使投(tou)(tou)(tou)(tou)資(zi)(zi)人(ren)群體、私募(mu)股(gu)權(quan)、創業(ye)(ye)(ye)投(tou)(tou)(tou)(tou)資(zi)(zi)等(deng)擴大(da)中小(xiao)企業(ye)(ye)(ye)股(gu)權(quan)融(rong)資(zi)(zi),更多地(di)投(tou)(tou)(tou)(tou)長、投(tou)(tou)(tou)(tou)早(zao)、投(tou)(tou)(tou)(tou)小(xiao)、投(tou)(tou)(tou)(tou)創新。穩步(bu)(bu)推(tui)(tui)進(jin)以信息披露(lu)為核心的(de)注冊(ce)制(zhi)(zhi)(zhi)改(gai)(gai)革(ge),支持更多優質(zhi)中小(xiao)企業(ye)(ye)(ye)登陸資(zi)(zi)本市(shi)場(chang)。鼓(gu)勵中小(xiao)企業(ye)(ye)(ye)通過(guo)并購重組對(dui)接資(zi)(zi)本市(shi)場(chang)。穩步(bu)(bu)推(tui)(tui)進(jin)新三(san)板(ban)改(gai)(gai)革(ge),健全掛牌(pai)公司轉板(ban)上市(shi)機制(zhi)(zhi)(zhi)。完(wan)善(shan)中小(xiao)企業(ye)(ye)(ye)上市(shi)培育機制(zhi)(zhi)(zhi),鼓(gu)勵地(di)方加大(da)對(dui)小(xiao)升規(gui)、規(gui)改(gai)(gai)股(gu)、股(gu)上市(shi)企業(ye)(ye)(ye)的(de)支持。加大(da)優質(zhi)中小(xiao)企業(ye)(ye)(ye)債券融(rong)資(zi)(zi),通過(guo)市(shi)場(chang)化(hua)機制(zhi)(zhi)(zhi)開發更多適合(he)中小(xiao)企業(ye)(ye)(ye)的(de)債券品種,完(wan)善(shan)中小(xiao)企業(ye)(ye)(ye)債券融(rong)資(zi)(zi)增信機制(zhi)(zhi)(zhi),擴大(da)債券融(rong)資(zi)(zi)規(gui)模(mo)。




(十三)完善(shan)中小企業(ye)(ye)融(rong)資(zi)(zi)擔(dan)(dan)(dan)保體系。健全政府性融(rong)資(zi)(zi)擔(dan)(dan)(dan)保體系,發揮國家融(rong)資(zi)(zi)擔(dan)(dan)(dan)保基(ji)金(jin)作(zuo)用(yong),實(shi)施小微企業(ye)(ye)融(rong)資(zi)(zi)擔(dan)(dan)(dan)保降費(fei)獎補(bu)政策,完善(shan)風(feng)險(xian)補(bu)償機(ji)(ji)制(zhi)(zhi)和(he)績(ji)效考核激勵(li)機(ji)(ji)制(zhi)(zhi),引(yin)導各級(ji)政府性融(rong)資(zi)(zi)擔(dan)(dan)(dan)保機(ji)(ji)構(gou)擴大小微企業(ye)(ye)融(rong)資(zi)(zi)擔(dan)(dan)(dan)保業(ye)(ye)務規模、降低擔(dan)(dan)(dan)保費(fei)率水平。鼓勵(li)銀行業(ye)(ye)金(jin)融(rong)機(ji)(ji)構(gou)加大與政府性融(rong)資(zi)(zi)擔(dan)(dan)(dan)保機(ji)(ji)構(gou)合作(zuo),合理確定風(feng)險(xian)分擔(dan)(dan)(dan)比例和(he)擔(dan)(dan)(dan)保貸(dai)款風(feng)險(xian)權(quan)重,落實(shi)金(jin)融(rong)機(ji)(ji)構(gou)和(he)融(rong)資(zi)(zi)擔(dan)(dan)(dan)保機(ji)(ji)構(gou)盡職免責制(zhi)(zhi)度,提高(gao)小微企業(ye)(ye)融(rong)資(zi)(zi)可獲得性。推(tui)動建(jian)立統一的動產和(he)權(quan)利擔(dan)(dan)(dan)保登記公示系統。




四(si)、建立和健全中小(xiao)企業(ye)創新(xin)發展制度




(十四)完善(shan)創(chuang)(chuang)業(ye)(ye)(ye)扶持制度。改善(shan)創(chuang)(chuang)業(ye)(ye)(ye)環境,廣(guang)泛(fan)培育(yu)創(chuang)(chuang)業(ye)(ye)(ye)主(zhu)體。完善(shan)創(chuang)(chuang)業(ye)(ye)(ye)載體建設(she),健全扶持與評價機制,為(wei)小微企(qi)業(ye)(ye)(ye)創(chuang)(chuang)業(ye)(ye)(ye)提(ti)(ti)供(gong)低(di)成本、便利化(hua)(hua)、高質量服務。鼓(gu)勵大企(qi)業(ye)(ye)(ye)發揮技術優勢(shi)、人(ren)才優勢(shi)和(he)市(shi)場優勢(shi),為(wei)創(chuang)(chuang)業(ye)(ye)(ye)活動提(ti)(ti)供(gong)支撐。鼓(gu)勵服務機構提(ti)(ti)供(gong)創(chuang)(chuang)業(ye)(ye)(ye)相(xiang)關規范化(hua)(hua)、專業(ye)(ye)(ye)化(hua)(hua)服務。

(十九)健全促進中(zhong)小企(qi)業(ye)(ye)管(guan)理提升機制(zhi)。完善中(zhong)小企(qi)業(ye)(ye)培(pei)(pei)訓制(zhi)度(du),構建具有時(shi)代特(te)點(dian)的(de)課程(cheng)、教材、師資和組(zu)織(zhi)體系(xi),建設慕課平(ping)臺,構建多領域(yu)、多層次(ci)、線上線下相結合的(de)中(zhong)小企(qi)業(ye)(ye)培(pei)(pei)訓體系(xi)。健全技能(neng)人才(cai)培(pei)(pei)養、使用、評價、激(ji)勵制(zhi)度(du),加快培(pei)(pei)養高素質技能(neng)人才(cai),弘揚“工(gong)匠精神”。健全中(zhong)小企(qi)業(ye)(ye)品牌培(pei)(pei)育機制(zhi)。實(shi)施小微企(qi)業(ye)(ye)質量(liang)管(guan)理提升行(xing)動。完善中(zhong)小企(qi)業(ye)(ye)管(guan)理咨詢服務機制(zhi)。




(二十)夯實中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)國(guo)際(ji)交(jiao)流合(he)作(zuo)機(ji)制(zhi)。深(shen)化雙多邊(bian)中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)合(he)作(zuo)機(ji)制(zhi),促進中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)國(guo)際(ji)交(jiao)流合(he)作(zuo)。探(tan)索建(jian)設中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)海外服(fu)(fu)務體系,夯實中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)國(guo)際(ji)化發(fa)展(zhan)(zhan)服(fu)(fu)務機(ji)制(zhi),在國(guo)際(ji)商務法務咨詢、知識產權保護、技術性貿易措施(shi)、質量認(ren)證(zheng)等方面為中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)提供幫(bang)助。支持(chi)有條(tiao)件的地方建(jian)設中(zhong)(zhong)(zhong)外中(zhong)(zhong)(zhong)小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)(ye)合(he)作(zuo)區(qu),完善評價激勵(li)機(ji)制(zhi)。推進關稅保證(zheng)保險改革。鼓(gu)勵(li)跨境(jing)電商等新業(ye)(ye)(ye)態(tai)發(fa)展(zhan)(zhan),探(tan)索建(jian)立B2B出口監(jian)管(guan)制(zhi)度,支持(chi)跨境(jing)電商優(you)進優(you)出。




六、建立和健全(quan)中(zhong)小(xiao)企業合法(fa)權益保護(hu)制度




(二(er)十一(yi))構建保護(hu)中小企(qi)業(ye)(ye)(ye)及企(qi)業(ye)(ye)(ye)家合(he)法(fa)財(cai)(cai)產(chan)(chan)權(quan)制(zhi)(zhi)度(du)。堅決(jue)保護(hu)中小企(qi)業(ye)(ye)(ye)及企(qi)業(ye)(ye)(ye)家合(he)法(fa)財(cai)(cai)產(chan)(chan)權(quan),依法(fa)懲治侵犯中小企(qi)業(ye)(ye)(ye)投資者(zhe)、管理者(zhe)和從業(ye)(ye)(ye)人(ren)(ren)(ren)員(yuan)(yuan)合(he)法(fa)權(quan)益的(de)違(wei)法(fa)犯罪行為。嚴格按照(zhao)法(fa)定程序(xu)采取查封、扣押、凍結等(deng)措施,依法(fa)嚴格區(qu)分(fen)違(wei)法(fa)所(suo)得、其他涉(she)案(an)財(cai)(cai)產(chan)(chan)與(yu)合(he)法(fa)財(cai)(cai)產(chan)(chan),嚴格區(qu)分(fen)企(qi)業(ye)(ye)(ye)法(fa)人(ren)(ren)(ren)財(cai)(cai)產(chan)(chan)與(yu)股(gu)東個人(ren)(ren)(ren)財(cai)(cai)產(chan)(chan),嚴格區(qu)分(fen)涉(she)案(an)人(ren)(ren)(ren)員(yuan)(yuan)個人(ren)(ren)(ren)財(cai)(cai)產(chan)(chan)與(yu)家庭成(cheng)員(yuan)(yuan)財(cai)(cai)產(chan)(chan)。建立涉(she)政府產(chan)(chan)權(quan)糾紛治理長效(xiao)機(ji)制(zhi)(zhi)。出(chu)臺(tai)并落實《保障中小企(qi)業(ye)(ye)(ye)款項支付條例》,從源頭遏制(zhi)(zhi)拖欠問題(ti)。




(二十(shi)二)健全中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)保(bao)護(hu)(hu)制度(du)。完善(shan)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)保(bao)護(hu)(hu)法律(lv)法規和政(zheng)策,建(jian)立(li)健全懲罰性賠(pei)償制度(du),提高(gao)(gao)法定賠(pei)償額。實施中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)戰略推(tui)(tui)進(jin)工(gong)(gong)程,加強知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)服(fu)務業(ye)(ye)集聚發(fa)展區建(jian)設,強化(hua)專利導航工(gong)(gong)作(zuo)機(ji)制,完善(shan)支持(chi)中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)開發(fa)自主(zhu)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)技(ji)術和產(chan)(chan)品的(de)政(zheng)策,提升中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)創造、運用、保(bao)護(hu)(hu)和管理知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)能力。優化(hua)中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)維(wei)權(quan)(quan)(quan)機(ji)制,建(jian)設一批知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)保(bao)護(hu)(hu)中心。構建(jian)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)糾紛多元化(hua)解決機(ji)制,強化(hua)中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)信息公共服(fu)務,推(tui)(tui)進(jin)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)糾紛仲裁調解工(gong)(gong)作(zuo)。提高(gao)(gao)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)審(shen)查效率(lv),減輕(qing)中小(xiao)(xiao)(xiao)企(qi)業(ye)(ye)申請和維(wei)持(chi)知(zhi)識(shi)(shi)(shi)(shi)產(chan)(chan)權(quan)(quan)(quan)的(de)費用負擔(dan)。




(二十(shi)三(san))完善(shan)中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)維權(quan)(quan)救濟(ji)(ji)制(zhi)度(du)。構建統一的政務(wu)咨(zi)詢(xun)投(tou)訴(su)舉(ju)報(bao)平臺,暢通中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)表達訴(su)求渠道,完善(shan)咨(zi)詢(xun)投(tou)訴(su)舉(ju)報(bao)處(chu)理(li)程序(xu)和督辦考核(he)機(ji)制(zhi)。探索建立中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)公(gong)(gong)(gong)益訴(su)訟(song)制(zhi)度(du)、國(guo)際維權(quan)(quan)服(fu)務(wu)機(ji)制(zhi)。鼓勵(li)法(fa)律(lv)服(fu)務(wu)機(ji)構開展小(xiao)微企(qi)業(ye)法(fa)律(lv)咨(zi)詢(xun)公(gong)(gong)(gong)益服(fu)務(wu)。建立健全(quan)中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)應(ying)急救援救濟(ji)(ji)機(ji)制(zhi),幫助中(zhong)(zhong)(zhong)小(xiao)企(qi)業(ye)應(ying)對自(zi)然災害(hai)、事(shi)故災難(nan)、公(gong)(gong)(gong)共衛(wei)生事(shi)件(jian)(jian)和社會安全(quan)事(shi)件(jian)(jian)等不可抗力事(shi)件(jian)(jian)。




七、強化促進中小企業(ye)發(fa)展組織領導(dao)制度




(二十(shi)四)強化各級(ji)促進中(zhong)小(xiao)(xiao)(xiao)企業(ye)發(fa)展(zhan)工(gong)作(zuo)機(ji)制(zhi)。縣級(ji)以上地方人民政府(fu)必須(xu)建立健全促進中(zhong)小(xiao)(xiao)(xiao)企業(ye)發(fa)展(zhan)領(ling)導(dao)小(xiao)(xiao)(xiao)組(zu)(zu),由政府(fu)領(ling)導(dao)擔(dan)任(ren)領(ling)導(dao)小(xiao)(xiao)(xiao)組(zu)(zu)組(zu)(zu)長(chang),辦公室設(she)(she)在負責(ze)中(zhong)小(xiao)(xiao)(xiao)企業(ye)促進工(gong)作(zuo)的綜合管理(li)部(bu)門,強化促進中(zhong)小(xiao)(xiao)(xiao)企業(ye)發(fa)展(zhan)工(gong)作(zuo)隊伍(wu)建設(she)(she)。領(ling)導(dao)小(xiao)(xiao)(xiao)組(zu)(zu)要定期召開會議研究(jiu)落(luo)實黨中(zhong)央、國務院促進中(zhong)小(xiao)(xiao)(xiao)企業(ye)發(fa)展(zhan)的重大決策(ce)部(bu)署,及時向(xiang)上一級(ji)領(ling)導(dao)小(xiao)(xiao)(xiao)組(zu)(zu)辦公室報告(gao)有(you)關(guan)工(gong)作(zuo)情況(kuang)。領(ling)導(dao)小(xiao)(xiao)(xiao)組(zu)(zu)各成員單位要認真(zhen)執行領(ling)導(dao)小(xiao)(xiao)(xiao)組(zu)(zu)議定事項,建立內部(bu)責(ze)任(ren)制(zhi),加強工(gong)作(zuo)落(luo)實。




(二十五)完(wan)善中(zhong)(zhong)小(xiao)企(qi)業決(jue)策(ce)保(bao)障工(gong)作機(ji)(ji)制。完(wan)善中(zhong)(zhong)小(xiao)企(qi)業政(zheng)策(ce)咨詢制度,培育一(yi)批聚焦(jiao)中(zhong)(zhong)小(xiao)企(qi)業研(yan)究的中(zhong)(zhong)國特色新(xin)型智庫,建(jian)立政(zheng)策(ce)出(chu)臺前征求中(zhong)(zhong)小(xiao)企(qi)業與專家(jia)意見制度和(he)政(zheng)策(ce)實(shi)施效果評(ping)估制度。完(wan)善中(zhong)(zhong)小(xiao)企(qi)業政(zheng)策(ce)發布(bu)、解讀和(he)輿(yu)情引導機(ji)(ji)制,提高政(zheng)策(ce)知曉(xiao)率、獲(huo)得(de)感(gan)和(he)滿意度。定期開(kai)展中(zhong)(zhong)小(xiao)企(qi)業發展環境第(di)三方評(ping)估,并向社會(hui)公布(bu)結果。
