國辦:全面推行證明事項和涉企經營許可事項告知承諾制

各(ge)(ge)(ge)省、自(zi)治區(qu)、直(zhi)轄市人(ren)民政(zheng)府,國務院各(ge)(ge)(ge)部委、各(ge)(ge)(ge)直(zhi)屬機構:
持續開(kai)展“減(jian)證(zheng)(zheng)(zheng)便民”行(xing)動,深化(hua)“證(zheng)(zheng)(zheng)照分(fen)離(li)”改革(ge),是黨中央、國(guo)(guo)務(wu)(wu)(wu)(wu)院(yuan)重(zhong)大決(jue)策部(bu)署,是深入推進簡政放權、放管(guan)結合、優(you)化(hua)服務(wu)(wu)(wu)(wu)改革(ge)的(de)重(zhong)點工(gong)(gong)作。2019年5月,國(guo)(guo)務(wu)(wu)(wu)(wu)院(yuan)決(jue)定,在天(tian)津等(deng)(deng)13個省(直轄市(shi))和(he)(he)公安部(bu)等(deng)(deng)5個國(guo)(guo)務(wu)(wu)(wu)(wu)院(yuan)部(bu)門開(kai)展證(zheng)(zheng)(zheng)明事項告知承諾(nuo)(nuo)制試點。2015年以(yi)來,國(guo)(guo)務(wu)(wu)(wu)(wu)院(yuan)決(jue)定,在上海市(shi)浦東新區等(deng)(deng)地對(dui)(dui)部(bu)分(fen)涉企(qi)經(jing)營許可事項實(shi)(shi)行(xing)告知承諾(nuo)(nuo)制并逐步向全(quan)國(guo)(guo)復制推廣。這些改革(ge)實(shi)(shi)踐取得了(le)積(ji)極(ji)成效,對(dui)(dui)減(jian)少證(zheng)(zheng)(zheng)明事項、簡化(hua)行(xing)政審批、方(fang)便企(qi)業(ye)和(he)(he)群眾辦事創業(ye)發揮了(le)重(zhong)要作用。為(wei)深化(hua)“放管(guan)服”改革(ge)、優(you)化(hua)營商(shang)環境,激(ji)發市(shi)場主體(ti)發展活(huo)力和(he)(he)社(she)會(hui)創造力,依法保(bao)障(zhang)和(he)(he)服務(wu)(wu)(wu)(wu)疫情防控(kong)常態化(hua)條件(jian)下經(jing)濟社(she)會(hui)發展,扎實(shi)(shi)做好“六穩”工(gong)(gong)作、全(quan)面落實(shi)(shi)“六保(bao)”任務(wu)(wu)(wu)(wu),經(jing)國(guo)(guo)務(wu)(wu)(wu)(wu)院(yuan)同(tong)意(yi),現就各地區、各部(bu)門全(quan)面推行(xing)證(zheng)(zheng)(zheng)明事項和(he)(he)涉企(qi)經(jing)營許可事項告知承諾(nuo)(nuo)制提出以(yi)下意(yi)見。
一、總體(ti)要求
(一)指導思(si)(si)(si)想。以(yi)習近平新時代(dai)中(zhong)國特色社(she)會主義思(si)(si)(si)想為(wei)指導,全(quan)面貫徹黨的十九大和十九屆二中(zhong)、三中(zhong)、四(si)中(zhong)、五中(zhong)全(quan)會精神,按(an)照(zhao)黨中(zhong)央、國務院決策部署,堅持以(yi)人民(min)為(wei)中(zhong)心的發(fa)展思(si)(si)(si)想,深入推(tui)(tui)進“放管服”改革,加快轉變政(zheng)(zheng)府(fu)職能,針(zhen)對直接面向(xiang)企(qi)業(ye)和群眾(zhong)、依申請(qing)辦(ban)理(li)(li)的行(xing)(xing)政(zheng)(zheng)事(shi)(shi)項,全(quan)面推(tui)(tui)行(xing)(xing)證明(ming)事(shi)(shi)項和涉企(qi)經營許(xu)可事(shi)(shi)項告知承諾制,創新政(zheng)(zheng)府(fu)服務和管理(li)(li)的理(li)(li)念、方式,方便企(qi)業(ye)和群眾(zhong)辦(ban)事(shi)(shi)創業(ye),推(tui)(tui)進政(zheng)(zheng)府(fu)治理(li)(li)體(ti)系和治理(li)(li)能力現代(dai)化,努力建(jian)設人民(min)滿意的服務型政(zheng)(zheng)府(fu)。
(二)基本原則。
——堅持問題導向。以(yi)方(fang)便企(qi)(qi)(qi)業和(he)群眾辦(ban)(ban)事創(chuang)業為(wei)導向,聚(ju)焦企(qi)(qi)(qi)業和(he)群眾辦(ban)(ban)事創(chuang)業的“堵點”、“痛點”,切實解決企(qi)(qi)(qi)業和(he)群眾辦(ban)(ban)證多、辦(ban)(ban)事難(nan)等問題。
——堅持(chi)高效(xiao)便民(min)(min)。以(yi)社(she)會普遍關注的領域和事項為重點,優化辦(ban)事流程,完(wan)善便民(min)(min)服務措施,進一步(bu)提高工作(zuo)的針(zhen)對性(xing)(xing)、實(shi)效(xiao)性(xing)(xing),力戒形(xing)式主義(yi)、官僚主義(yi)。
——堅持協同推進(jin)。加強與政務(wu)信(xin)息資源共享、信(xin)用體(ti)系建設、“互(hu)聯網+政務(wu)服(fu)務(wu)”等工作的(de)銜(xian)接(jie),充分發揮(hui)疊加效應,形(xing)成協同推進(jin)的(de)體(ti)制機(ji)制。
——堅(jian)持風險可控。結(jie)合各地區經濟社會發展實際和(he)各部門行政管理工作實際,穩妥(tuo)有(you)序推(tui)(tui)進(jin)改(gai)革(ge)。堅(jian)持分(fen)級分(fen)類(lei),精(jing)準確定實行告知承(cheng)諾制的事(shi)項范圍,因地制宜,因類(lei)施策,分(fen)步推(tui)(tui)進(jin),動態調整。落實放(fang)管結(jie)合、并重的要求(qiu),創(chuang)新和(he)加強(qiang)事(shi)中(zhong)事(shi)后(hou)監(jian)管,有(you)效監(jian)督(du)承(cheng)諾履行情況,實現過程可控、風險可控,維護(hu)企(qi)業和(he)群眾(zhong)合法(fa)權益。
(三)工作(zuo)目標。在各級行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)機關或者法(fa)律法(fa)規(gui)授權的(de)具有管(guan)理(li)公共事(shi)(shi)(shi)(shi)(shi)務(wu)職能的(de)組織(以(yi)下(xia)統稱(cheng)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)機關)辦(ban)理(li)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)許可(ke)、行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)確認、行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)給付等(deng)依(yi)申請的(de)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)事(shi)(shi)(shi)(shi)(shi)項(以(yi)下(xia)簡稱(cheng)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)事(shi)(shi)(shi)(shi)(shi)項)要求提(ti)供證(zheng)(zheng)明(ming)(ming)(ming)材料時實行(xing)(xing)(xing)(xing)(xing)證(zheng)(zheng)明(ming)(ming)(ming)事(shi)(shi)(shi)(shi)(shi)項告知(zhi)(zhi)(zhi)承諾制,在行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)機關辦(ban)理(li)涉企(qi)(qi)經營許可(ke)事(shi)(shi)(shi)(shi)(shi)項時實行(xing)(xing)(xing)(xing)(xing)告知(zhi)(zhi)(zhi)承諾制,以(yi)行(xing)(xing)(xing)(xing)(xing)政(zheng)(zheng)機關清楚告知(zhi)(zhi)(zhi)、企(qi)(qi)業和群(qun)眾誠(cheng)信(xin)守(shou)諾為重點(dian),推動(dong)形(xing)成標準公開、規(gui)則公平、預期明(ming)(ming)(ming)確、各負(fu)其責(ze)、信(xin)用監管(guan)的(de)治理(li)模式,從制度層(ceng)面進(jin)一步(bu)解決企(qi)(qi)業和群(qun)眾辦(ban)證(zheng)(zheng)多、辦(ban)事(shi)(shi)(shi)(shi)(shi)難等(deng)問題。
二、主要任(ren)務(wu)
(四)明(ming)確實行(xing)告(gao)知承諾(nuo)制的(de)(de)證(zheng)明(ming)事項(xiang)。本意見所稱證(zheng)明(ming),是指公民、法(fa)(fa)人和其他(ta)組織在(zai)依(yi)法(fa)(fa)向行(xing)政(zheng)機(ji)(ji)關申請辦(ban)(ban)理行(xing)政(zheng)事項(xiang)時(shi),提供(gong)的(de)(de)需(xu)要由行(xing)政(zheng)機(ji)(ji)關或者(zhe)其他(ta)機(ji)(ji)構出具、用(yong)以描述(shu)客觀事實或者(zhe)表(biao)明(ming)符(fu)合特定條件的(de)(de)材料。證(zheng)明(ming)事項(xiang)告(gao)知承諾(nuo)制,是指公民、法(fa)(fa)人和其他(ta)組織在(zai)向行(xing)政(zheng)機(ji)(ji)關申請辦(ban)(ban)理行(xing)政(zheng)事項(xiang)時(shi),行(xing)政(zheng)機(ji)(ji)關以書(shu)面形式(shi)(含電(dian)子文(wen)本,下同)將(jiang)證(zheng)明(ming)義務(wu)、證(zheng)明(ming)內(nei)容以及不實承諾(nuo)的(de)(de)法(fa)(fa)律(lv)責(ze)任(ren)一次性告(gao)知申請人,申請人書(shu)面承諾(nuo)已經符(fu)合告(gao)知的(de)(de)相(xiang)關要求并愿意承擔不實承諾(nuo)的(de)(de)法(fa)(fa)律(lv)責(ze)任(ren),行(xing)政(zheng)機(ji)(ji)關不再索要有(you)關證(zheng)明(ming)并依(yi)據書(shu)面承諾(nuo)辦(ban)(ban)理相(xiang)關行(xing)政(zheng)事項(xiang)的(de)(de)工作機(ji)(ji)制。
各省、自治區、直轄市人民(min)政府,實(shi)行垂直管(guan)理的(de)國務院部門(men)和實(shi)行以(yi)部門(men)為主的(de)雙重(zhong)領導管(guan)理體(ti)制的(de)系統(tong)要(yao)結合實(shi)際確(que)定(ding)實(shi)行告(gao)(gao)(gao)知(zhi)(zhi)承諾(nuo)(nuo)制的(de)證(zheng)明事(shi)(shi)項范圍(wei),國務院其他(ta)部門(men)要(yao)確(que)定(ding)部門(men)本級實(shi)行告(gao)(gao)(gao)知(zhi)(zhi)承諾(nuo)(nuo)制的(de)證(zheng)明事(shi)(shi)項范圍(wei)。要(yao)按照最大限度利(li)民(min)便民(min)原則,有針對性(xing)地(di)選(xuan)取與企(qi)業和群眾(zhong)生(sheng)產(chan)生(sheng)活密(mi)切(qie)相關(guan)、使用頻次較高或(huo)者獲(huo)取難度較大的(de)證(zheng)明事(shi)(shi)項實(shi)行告(gao)(gao)(gao)知(zhi)(zhi)承諾(nuo)(nuo)制,特別是在戶籍管(guan)理、市場主體(ti)準營、資格考試(shi)、社(she)會(hui)保險、社(she)會(hui)救助、健康體(ti)檢、法律服務等方面(mian),要(yao)抓緊推行、盡快落實(shi)。直接涉及(ji)國家(jia)安(an)全(quan)、國家(jia)秘密(mi)、公共(gong)安(an)全(quan)、金融業審慎監管(guan)、生(sheng)態環境保護,直接關(guan)系人身健康、生(sheng)命財產(chan)安(an)全(quan),以(yi)及(ji)重(zhong)要(yao)涉外等風(feng)險較大、糾(jiu)錯成本較高、損害難以(yi)挽回的(de)證(zheng)明事(shi)(shi)項不適用告(gao)(gao)(gao)知(zhi)(zhi)承諾(nuo)(nuo)制。
(五)明確實(shi)行告(gao)(gao)知(zhi)承(cheng)諾(nuo)制(zhi)的(de)涉(she)企經(jing)營許(xu)(xu)可(ke)(ke)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)范圍(wei)。對涉(she)企經(jing)營許(xu)(xu)可(ke)(ke)事(shi)(shi)(shi)項(xiang)(xiang)(xiang),申(shen)請人(ren)就(jiu)其符合(he)許(xu)(xu)可(ke)(ke)條件作出(chu)承(cheng)諾(nuo),通過事(shi)(shi)(shi)中事(shi)(shi)(shi)后(hou)監(jian)管能夠(gou)糾(jiu)正不符合(he)許(xu)(xu)可(ke)(ke)條件行為、有(you)效防(fang)范風險(xian)的(de),實(shi)行告(gao)(gao)知(zhi)承(cheng)諾(nuo)制(zhi)。法(fa)律(lv)、行政(zheng)(zheng)法(fa)規、國(guo)務(wu)院決定(ding)設(she)定(ding)的(de)涉(she)企經(jing)營許(xu)(xu)可(ke)(ke)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)實(shi)行告(gao)(gao)知(zhi)承(cheng)諾(nuo)制(zhi)的(de),由國(guo)務(wu)院審改(gai)辦(ban)會(hui)同國(guo)務(wu)院有(you)關(guan)部(bu)(bu)門研(yan)(yan)究提出(chu)建(jian)議,報國(guo)務(wu)院批準(zhun)。地方性法(fa)規、地方政(zheng)(zheng)府規章設(she)定(ding)的(de)涉(she)企經(jing)營許(xu)(xu)可(ke)(ke)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)實(shi)行告(gao)(gao)知(zhi)承(cheng)諾(nuo)制(zhi)的(de),由省(sheng)、自治區、直(zhi)轄市或(huo)者設(she)區的(de)市、自治州審改(gai)辦(ban)會(hui)同有(you)關(guan)部(bu)(bu)門研(yan)(yan)究提出(chu)建(jian)議,報本(ben)級人(ren)民(min)政(zheng)(zheng)府批準(zhun)。涉(she)及法(fa)律(lv)法(fa)規規章調(diao)整的(de),要依法(fa)獲得授權(quan),推(tui)動(dong)相關(guan)法(fa)律(lv)法(fa)規規章立改(gai)廢釋(shi)。涉(she)企經(jing)營許(xu)(xu)可(ke)(ke)事(shi)(shi)(shi)項(xiang)(xiang)(xiang)以外的(de)行政(zheng)(zheng)許(xu)(xu)可(ke)(ke)事(shi)(shi)(shi)項(xiang)(xiang)(xiang),可(ke)(ke)參照本(ben)意見實(shi)行告(gao)(gao)知(zhi)承(cheng)諾(nuo)制(zhi)。
(六)確(que)定告知(zhi)承(cheng)(cheng)諾(nuo)(nuo)(nuo)制(zhi)的適用(yong)(yong)對(dui)(dui)象。對(dui)(dui)于實行告知(zhi)承(cheng)(cheng)諾(nuo)(nuo)(nuo)制(zhi)的證明事項和涉企(qi)經營許可事項,申(shen)請(qing)人可自主選擇是否采(cai)用(yong)(yong)告知(zhi)承(cheng)(cheng)諾(nuo)(nuo)(nuo)制(zhi)方(fang)式辦理。申(shen)請(qing)人不愿承(cheng)(cheng)諾(nuo)(nuo)(nuo)或者(zhe)無法承(cheng)(cheng)諾(nuo)(nuo)(nuo)的,應當提交法律法規(gui)或者(zhe)國務院決(jue)定要(yao)求(qiu)的證明,或者(zhe)按照(zhao)一般程序辦理涉企(qi)經營許可事項。申(shen)請(qing)人有(you)較嚴重(zhong)的不良信用(yong)(yong)記錄或者(zhe)存在曾(ceng)作(zuo)出虛假(jia)承(cheng)(cheng)諾(nuo)(nuo)(nuo)等情形的,在信用(yong)(yong)修復前不適用(yong)(yong)告知(zhi)承(cheng)(cheng)諾(nuo)(nuo)(nuo)制(zhi)。

(八)加強(qiang)事中(zhong)(zhong)事后核查。要針對事項特點等分類確定(ding)(ding)核查辦(ban)法(fa),將承諾人的信(xin)用狀況(kuang)作為確定(ding)(ding)核查辦(ban)法(fa)的重(zhong)要因素,明確核查時間(jian)、標準、方(fang)式(shi)以及是否免予(yu)核查。對免予(yu)核查的事項,行政(zheng)機關要綜合(he)運用“雙隨機、一公開(kai)”監(jian)管(guan)、重(zhong)點監(jian)管(guan)、“互聯網(wang)+監(jian)管(guan)”、智慧監(jian)管(guan)等方(fang)式(shi)實(shi)施日常(chang)監(jian)管(guan),不(bu)得對通過(guo)告知(zhi)承諾制(zhi)方(fang)式(shi)辦(ban)理的企業和(he)群眾采取歧視性(xing)監(jian)管(guan)措(cuo)施。對在核查或者(zhe)日常(chang)監(jian)管(guan)中(zhong)(zhong)發現承諾不(bu)實(shi)的,行政(zheng)機關要依(yi)法(fa)終止辦(ban)理、責令限期整改、撤銷行政(zheng)決定(ding)(ding)或者(zhe)予(yu)以行政(zheng)處罰,并納入信(xin)用記(ji)錄。涉嫌犯罪的,依(yi)法(fa)移送司法(fa)機關。
各地區(qu)(qu)(qu)、各部(bu)門(men)要認(ren)真貫徹落實(shi)《國務(wu)(wu)(wu)(wu)(wu)院關(guan)(guan)于在線(xian)政(zheng)務(wu)(wu)(wu)(wu)(wu)服(fu)務(wu)(wu)(wu)(wu)(wu)的(de)(de)若干規定》。國務(wu)(wu)(wu)(wu)(wu)院各部(bu)門(men)要及時解(jie)決部(bu)門(men)與省、自治區(qu)(qu)(qu)、直(zhi)轄市人民(min)政(zheng)府間(jian)政(zheng)務(wu)(wu)(wu)(wu)(wu)信(xin)息(xi)資源共(gong)(gong)享不(bu)暢問題,各地區(qu)(qu)(qu)要扎實(shi)推進(jin)本(ben)地區(qu)(qu)(qu)政(zheng)務(wu)(wu)(wu)(wu)(wu)信(xin)息(xi)共(gong)(gong)享工作,依托(tuo)全國一(yi)體(ti)化政(zheng)務(wu)(wu)(wu)(wu)(wu)服(fu)務(wu)(wu)(wu)(wu)(wu)平臺(tai)等實(shi)現(xian)跨(kua)地區(qu)(qu)(qu)、跨(kua)部(bu)門(men)、跨(kua)層級數據(ju)共(gong)(gong)享和業務(wu)(wu)(wu)(wu)(wu)協(xie)(xie)同(tong),建(jian)立(li)告知承諾(nuo)制(zhi)在線(xian)核查(cha)(cha)支撐體(ti)系。行(xing)(xing)(xing)政(zheng)機關(guan)(guan)要利用(yong)政(zheng)務(wu)(wu)(wu)(wu)(wu)信(xin)息(xi)共(gong)(gong)享平臺(tai)、政(zheng)務(wu)(wu)(wu)(wu)(wu)服(fu)務(wu)(wu)(wu)(wu)(wu)移動客戶端(duan)、區(qu)(qu)(qu)塊(kuai)鏈技術等收集、比對(dui)相(xiang)關(guan)(guan)數據(ju),實(shi)施在線(xian)核查(cha)(cha),也可以(yi)通過檢(jian)查(cha)(cha)、勘(kan)驗等方(fang)式開展現(xian)場核查(cha)(cha)。確需進(jin)行(xing)(xing)(xing)現(xian)場核查(cha)(cha)的(de)(de),要依托(tuo)“互聯網(wang)+監管”平臺(tai)和應用(yong)程序等,將承諾(nuo)情況及時準確推送給有關(guan)(guan)監管人員,為一(yi)線(xian)監管執法提供(gong)信(xin)息(xi)支撐,同(tong)時要優化工作程序、加強業務(wu)(wu)(wu)(wu)(wu)協(xie)(xie)同(tong),避免(mian)煩企擾民(min)。相(xiang)關(guan)(guan)數據(ju)尚未實(shi)現(xian)網(wang)絡共(gong)(gong)享、難以(yi)通過上(shang)述方(fang)式核查(cha)(cha)的(de)(de),可以(yi)請求其他行(xing)(xing)(xing)政(zheng)機關(guan)(guan)協(xie)(xie)助(zhu)核查(cha)(cha),被請求協(xie)(xie)助(zhu)的(de)(de)行(xing)(xing)(xing)政(zheng)機關(guan)(guan)應當(dang)及時履行(xing)(xing)(xing)協(xie)(xie)助(zhu)義務(wu)(wu)(wu)(wu)(wu),不(bu)得推諉或者拒絕;確有原(yuan)因不(bu)能提供(gong)協(xie)(xie)助(zhu)的(de)(de),應當(dang)書面告知請求協(xie)(xie)助(zhu)的(de)(de)行(xing)(xing)(xing)政(zheng)機關(guan)(guan)并(bing)說(shuo)明理由(you)。
(九(jiu))加(jia)強信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)監管。要(yao)加(jia)強告知(zhi)承諾(nuo)(nuo)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)管理制(zhi)(zhi)度(du)建(jian)(jian)設,依法科學界定告知(zhi)承諾(nuo)(nuo)失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)行為(wei)。建(jian)(jian)立(li)告知(zhi)承諾(nuo)(nuo)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息記錄、歸集(ji)、推送(song)工作機(ji)制(zhi)(zhi),將承諾(nuo)(nuo)人履行承諾(nuo)(nuo)情(qing)況(kuang)(kuang)全面(mian)納入信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)記錄,依托各級(ji)(ji)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息共(gong)享平(ping)臺和(he)行業信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息系統,加(jia)強信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息互聯互通(tong)和(he)共(gong)享。按照信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)狀況(kuang)(kuang),實施分(fen)類精準(zhun)監管。探索建(jian)(jian)立(li)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)(yong)修復、異(yi)議(yi)處理機(ji)制(zhi)(zhi)。依法加(jia)大失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)懲戒力度(du),根據虛假(jia)承諾(nuo)(nuo)造(zao)成的社(she)會(hui)影響進行失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)程度(du)分(fen)級(ji)(ji),區分(fen)不(bu)同失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)情(qing)形實施相應懲戒措施。要(yao)根據有關(guan)法律規定,做好有關(guan)個人信(xin)(xin)(xin)(xin)(xin)(xin)息和(he)商業秘密保(bao)護。
(十)強(qiang)(qiang)(qiang)化(hua)(hua)(hua)風(feng)險(xian)(xian)(xian)防(fang)范措施。要梳理工作環節風(feng)險(xian)(xian)(xian)點,制(zhi)定(ding)防(fang)控措施,切實(shi)提(ti)高風(feng)險(xian)(xian)(xian)防(fang)范能力。要加(jia)強(qiang)(qiang)(qiang)行(xing)(xing)(xing)政(zheng)(zheng)指導,強(qiang)(qiang)(qiang)化(hua)(hua)(hua)告知和指導義(yi)務(wu)。建立承(cheng)(cheng)諾(nuo)退出機制(zhi),在行(xing)(xing)(xing)政(zheng)(zheng)事項辦(ban)結前,申(shen)請(qing)人有(you)合(he)理理由的(de),可(ke)以(yi)撤回(hui)承(cheng)(cheng)諾(nuo)申(shen)請(qing),撤回(hui)后(hou)應當按(an)原程序辦(ban)理。對(dui)涉(she)及社會(hui)(hui)公共利益(yi)、第三人利益(yi)或者核查(cha)難(nan)度(du)較(jiao)大(da)的(de)證明事項和涉(she)企經營許可(ke)事項,行(xing)(xing)(xing)政(zheng)(zheng)機關要根據政(zheng)(zheng)府信(xin)息公開等規(gui)定(ding),通(tong)過相(xiang)關服務(wu)場(chang)所、網站(zhan)和全(quan)國一體(ti)化(hua)(hua)(hua)政(zheng)(zheng)務(wu)服務(wu)平臺等向(xiang)社會(hui)(hui)公開告知承(cheng)(cheng)諾(nuo)書,接受社會(hui)(hui)監督。具備條件的(de)地區和部門可(ke)以(yi)探索(suo)(suo)建立事前信(xin)用預(yu)警系(xi)統,對(dui)申(shen)請(qing)人進行(xing)(xing)(xing)信(xin)用評估,加(jia)強(qiang)(qiang)(qiang)事前風(feng)險(xian)(xian)(xian)防(fang)控。對(dui)涉(she)及經濟(ji)利益(yi)價(jia)值(zhi)較(jiao)高、事中事后(hou)核查(cha)難(nan)度(du)較(jiao)大(da)的(de)事項,可(ke)以(yi)探索(suo)(suo)引入責任保(bao)險(xian)(xian)(xian)制(zhi)度(du),降低實(shi)行(xing)(xing)(xing)告知承(cheng)(cheng)諾(nuo)制(zhi)可(ke)能引發的(de)行(xing)(xing)(xing)政(zheng)(zheng)賠償(chang)風(feng)險(xian)(xian)(xian)。
三(san)、保障措施
(十一)加(jia)(jia)強(qiang)組織領導(dao)(dao)。各(ge)(ge)地區(qu)(qu)、各(ge)(ge)部(bu)(bu)門(men)(men)要切實加(jia)(jia)強(qiang)對本地區(qu)(qu)、本部(bu)(bu)門(men)(men)全(quan)(quan)面推行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)諾制(zhi)(zhi)(zhi)工作(zuo)(zuo)的(de)(de)(de)(de)(de)領導(dao)(dao),抓好組織實施。地方各(ge)(ge)級人民(min)(min)政府(fu)及(ji)其(qi)部(bu)(bu)門(men)(men)的(de)(de)(de)(de)(de)主要負責同(tong)志作(zuo)(zuo)為本地區(qu)(qu)、本部(bu)(bu)門(men)(men)全(quan)(quan)面推行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)諾制(zhi)(zhi)(zhi)工作(zuo)(zuo)的(de)(de)(de)(de)(de)第一責任人,要及(ji)時(shi)了解(jie)掌握有(you)(you)關工作(zuo)(zuo)情(qing)(qing)況,研究(jiu)解(jie)決工作(zuo)(zuo)中(zhong)(zhong)的(de)(de)(de)(de)(de)重大問(wen)題(ti),確保工作(zuo)(zuo)有(you)(you)方案、部(bu)(bu)署(shu)有(you)(you)進度(du)、推進有(you)(you)舉措、結果(guo)有(you)(you)考(kao)核。縣級以上地方人民(min)(min)政府(fu)要建(jian)立審改(gai)、司法行(xing)(xing)政、政務服務、信息公開、電子政務、發展改(gai)革、公安(an)、財政、稅務、市場監(jian)管等單(dan)(dan)位參加(jia)(jia)的(de)(de)(de)(de)(de)全(quan)(quan)面推行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)諾制(zhi)(zhi)(zhi)工作(zuo)(zuo)協調機制(zhi)(zhi)(zhi),明確牽頭(tou)單(dan)(dan)位,指(zhi)(zhi)導(dao)(dao)協調、督(du)促檢查工作(zuo)(zuo)推進情(qing)(qing)況。國務院各(ge)(ge)部(bu)(bu)門(men)(men)要切實做到(dao)(dao)率先(xian)推行(xing)(xing)、以上帶(dai)下,加(jia)(jia)強(qiang)對本系(xi)統(tong)全(quan)(quan)面推行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)諾制(zhi)(zhi)(zhi)工作(zuo)(zuo)的(de)(de)(de)(de)(de)督(du)促指(zhi)(zhi)導(dao)(dao),及(ji)時(shi)研究(jiu)解(jie)決本部(bu)(bu)門(men)(men)、本系(xi)統(tong)推行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)諾制(zhi)(zhi)(zhi)過程中(zhong)(zhong)遇到(dao)(dao)的(de)(de)(de)(de)(de)問(wen)題(ti),在(zai)本系(xi)統(tong)內適時(shi)復制(zhi)(zhi)(zhi)推廣全(quan)(quan)面推行(xing)(xing)告(gao)知(zhi)(zhi)承(cheng)諾制(zhi)(zhi)(zhi)的(de)(de)(de)(de)(de)典(dian)型經驗做法。同(tong)時(shi),及(ji)時(shi)建(jian)章立制(zhi)(zhi)(zhi),加(jia)(jia)強(qiang)制(zhi)(zhi)(zhi)度(du)建(jian)設。
(十二)開展培訓宣(xuan)傳。要組織開展告知(zhi)(zhi)承諾(nuo)(nuo)制學(xue)習培訓,加(jia)強業務交流。要加(jia)強對(dui)全(quan)面推(tui)行(xing)告知(zhi)(zhi)承諾(nuo)(nuo)制的(de)(de)宣(xuan)傳,通過報(bao)刊、廣播、電視、互聯(lian)網等渠道,全(quan)方(fang)位宣(xuan)傳全(quan)面推(tui)行(xing)告知(zhi)(zhi)承諾(nuo)(nuo)制的(de)(de)重要意義、主要做法(fa)、典型經驗和(he)實施(shi)效(xiao)果(guo)等,發(fa)揮示范帶動作用,合(he)理(li)引(yin)導社會(hui)(hui)預(yu)期,及時回(hui)應社會(hui)(hui)關切,為(wei)全(quan)面推(tui)行(xing)告知(zhi)(zhi)承諾(nuo)(nuo)制營造良(liang)好社會(hui)(hui)氛(fen)圍。
(十三(san))加強督促檢查。要(yao)把全(quan)面推(tui)行告知承諾制工(gong)作(zuo)推(tui)進情況納入(ru)法(fa)(fa)治(zhi)政府建設考評指標體(ti)(ti)系(xi)和年底效(xiao)能目標考核體(ti)(ti)系(xi),列為年度法(fa)(fa)治(zhi)政府建設督察內容,充分調動各方面積極性、主(zhu)動性。對工(gong)作(zuo)中(zhong)(zhong)表(biao)現突出、企業和群(qun)眾(zhong)評價滿意度高的(de)單位(wei)及(ji)人員,要(yao)按照(zhao)國(guo)家(jia)有關規定予以表(biao)彰和獎勵。建立(li)(li)督察情況通報制度,對工(gong)作(zuo)中(zhong)(zhong)違紀(ji)違法(fa)(fa)的(de)單位(wei)及(ji)人員要(yao)依(yi)紀(ji)依(yi)法(fa)(fa)問(wen)責(ze)(ze)。按照(zhao)“權責(ze)(ze)一致、盡職免責(ze)(ze)、失職追(zhui)責(ze)(ze)”原則,建立(li)(li)健全(quan)改革容錯機(ji)制,屬于合理容錯情形(xing)的(de),對相關單位(wei)及(ji)人員依(yi)紀(ji)依(yi)法(fa)(fa)免除(chu)相關責(ze)(ze)任或者(zhe)減(jian)輕(qing)(qing)、從輕(qing)(qing)處理。
各(ge)地區(qu)、各(ge)部門(men)要(yao)以全(quan)(quan)面推(tui)(tui)(tui)行(xing)證(zheng)(zheng)明(ming)事(shi)(shi)項(xiang)(xiang)(xiang)和(he)涉企經(jing)營許(xu)可事(shi)(shi)項(xiang)(xiang)(xiang)告(gao)知承諾制(zhi)為重要(yao)抓手,加(jia)(jia)快推(tui)(tui)(tui)進(jin)“放管(guan)服(fu)”改(gai)革,降低制(zhi)度性交(jiao)易成(cheng)本(ben),減輕企業和(he)群眾負擔,激發(fa)市(shi)場主(zhu)體(ti)發(fa)展活(huo)力。推(tui)(tui)(tui)進(jin)改(gai)革時,方向要(yao)明(ming)確,步驟(zou)要(yao)扎實穩(wen)妥(tuo)。各(ge)省(sheng)、自(zi)治區(qu)、直轄市(shi)人(ren)民(min)政府和(he)國務院(yuan)各(ge)部門(men)要(yao)于2020年12月31日前制(zhi)定(ding)本(ben)地區(qu)、本(ben)部門(men)全(quan)(quan)面推(tui)(tui)(tui)行(xing)證(zheng)(zheng)明(ming)事(shi)(shi)項(xiang)(xiang)(xiang)告(gao)知承諾制(zhi)的實施方案(an),并(bing)報(bao)司法部備案(an)。各(ge)省(sheng)、自(zi)治區(qu)、直轄市(shi)人(ren)民(min)政府和(he)國務院(yuan)有關(guan)部門(men)要(yao)制(zhi)定(ding)本(ben)地區(qu)、本(ben)部門(men)全(quan)(quan)面推(tui)(tui)(tui)行(xing)涉企經(jing)營許(xu)可事(shi)(shi)項(xiang)(xiang)(xiang)告(gao)知承諾制(zhi)的細化方案(an),并(bing)按要(yao)求(qiu)備案(an)。各(ge)地區(qu)、各(ge)部門(men)在全(quan)(quan)面推(tui)(tui)(tui)行(xing)證(zheng)(zheng)明(ming)事(shi)(shi)項(xiang)(xiang)(xiang)和(he)涉企經(jing)營許(xu)可事(shi)(shi)項(xiang)(xiang)(xiang)告(gao)知承諾制(zhi)過程中發(fa)現的問題,要(yao)及時分(fen)別(bie)報(bao)司法部、國務院(yuan)審(shen)改(gai)辦。司法部、國務院(yuan)審(shen)改(gai)辦要(yao)分(fen)別(bie)加(jia)(jia)強對(dui)全(quan)(quan)面推(tui)(tui)(tui)行(xing)證(zheng)(zheng)明(ming)事(shi)(shi)項(xiang)(xiang)(xiang)和(he)涉企經(jing)營許(xu)可事(shi)(shi)項(xiang)(xiang)(xiang)告(gao)知承諾制(zhi)的指導(dao)協(xie)調,會同有關(guan)部門(men)進(jin)行(xing)監督檢查和(he)跟蹤(zong)評估,重要(yao)情況及時報(bao)告(gao)國務院(yuan)。
